By browsing, accessing, using the site or ordering a product (“Order”), you agree to be legally bound by these Terms.
We may change these Terms at any time, and the revised Terms will be made available on our Site. By continuing to use the Site you agree to be bound by such revised Terms. or the Third Party Seller, as may be applicable.
Third Party Sellers
Please keep in mind that Third Party Seller listings are merely hosted on our site and are posted solely at the direction of Third Party Sellers.
Please note that the Site is a platform for the sale of products offered by both Arte et Marte Puzzles and Third Party Sellers. Third party sellers are independent retailers. Where an item is offered and sold by a Third Party Seller, the name of the seller, its terms including delivery fees, will be specified on the relevant product page. Third Party Sellers have the right in their absolute discretion at any time and without notice to amend, remove or vary the goods they offer on the site and/or their terms.
The site accepts product information from Third Party Sellers in good faith. Except where we are the seller, advertisements on the site for products are prepared by Third Party Sellers who are not related to us. We take no responsibility for the accuracy of price information or specifications of any products advertised and/or sold by Third Party Sellers.
To the extent permitted by Australian Law, we give no warranty in relation to any products offered for sale by Third Party Sellers on the site. Certain information on the site may be uploaded by Third Party Sellers. We don’t endorse or warrant the accuracy of this content nor do we accept any liability for inaccuracies or omissions in this content. Content and information on the site relating to goods offered for sale by Third Party Sellers do not imply our endorsement or liability in respect of such content.
Please ensure that you enter all information carefully when creating an account.
You are solely responsible for the activity that occurs on your account (including orders placed using your account), and you must keep your account password secure. We are not responsible for any unauthorised activity on your account, including if you fail to keep your account login information secure.
We may refer fraudulent or abusive or illegal activity to the relevant authorities.
You may not set up an account for someone else or if you are under 13 years old.
You must notify us immediately, if you become aware of any actual or potential unauthorised use of your password or account.
Preparation times on orders are generally 1 -2 days. If there are any delays to your order being prepared you will be notified.
By placing an order on the site, you are making an offer to enter into an agreement to purchase the product(s) in that order. Orders will be deemed received by us at the time we send an order confirmation to your nominated e-mail address. It is your responsibility to ensure that the correct email address and contact details are entered with your order.
Each order you place will be a separate contract. Each product in your order is either sold by us or the Third Party Seller specified as the seller of the product on the relevant product page.
We will not be liable to you for any loss you or any third party suffers as a result of, or in connection with, a delay or failure to process your order or deliver goods due to inaccurate or incomplete details provided in an order.
If you place consecutive or separate orders, we cannot consolidate your orders. A separate delivery fee, if applicable, will apply to each order. Subject to any applicable quantity restrictions, you can order as many goods as you wish in one order.
We reserve the right to accept or reject your order for any reason at any time. If we reject your order, you will receive a refund of any money paid.
Your order becomes a sale when it is dispatched and we have issued you a Tax Invoice.
Prior to placing your order, please read the product information page to determine if assembly is required. Unpacking, assembly and installation fees do not form part of your delivery fee.
If by chance our stock listed on the site fails to match existing stocklevels, we may not be able to fill your complete order. If this happens, we will refund you the price paid for the goods impacted.
We may withdraw or suspend from sale any good displayed on the site, either temporarily or permanently, at any time and without notice. We will not be liable to you for any loss you or any third party suffer as a result of a withdrawal or suspension of sale of a particular item. If we are unable to then fulfil your order, we will refund you the price paid for the goods impacted.
We reserve the right not to honour any incorrect offers represented on the site made by genuine human or system error. Where your order is affected by an error on the site (for example, in a description, an image, price or otherwise), we will reject that part of the order affected by the error. You will be refunded the value of that part of your order affected by the error, and we will fulfil the remainder of your order. If you are not satisfied with the partial fulfilment of your order, you can return your order to us under the “Returns Policy”.
If your order is affected by a genuine error (including in a description, an image or a price), we reserve the right to cancel your order and refund any money paid to us.
You acknowledge and agree that:
1) all pictures and images of goods displayed are for illustrative purposes only;
2) any accessory featured with the goods is for illustrative purposes only, and may be sold separately; and
3) where we provide dimensions and measurements in the description of a good, the dimensions may vary slightly in real life, and it is your responsibility to ensure that the actual size of each good is suitable for your purpose prior to submitting your order (including whether there is appropriate and safe access to your Delivery Address for delivery of the order).
If an item is subject to a product recall, you will be notified by email with instructions.
You consent to us contacting you or the gift recipient, using the personal information provided on your order, to notify you of a product recall by telephone, email, SMS, MMS or post.
All Prices are in Australian Dollars and, if GST applies, inclusive of GST. Any fees and charges (including delivery fees) imposed by these Terms also include GST where applicable.
We reserve the right to change or alter prices without notice to you. If you have already submitted an order at a particular price, we will supply your item at that price.
When you check out, we will charge you and you agree to pay the price and any applicable delivery fee.
A tax invoice will be issued once the sale has been processed.
Where you purchase was from one or more Third Party Seller, you will receive a tax invoice for products supplied and fulfilled by each Third Party Seller.
You agree to obtain consent to provide us with Personal Information of recipients of items or gifts ordered by you.
Payment methods are specified on the site and may include store gift card, coupon or accepted credit card. The name on any credit card or gift card used for payment must match the name on the order.
Any payment for an order must be received prior to your order being dispatched. If your payment cannot be processed, your order will be rejected, and you will be notified of this. If a credit card payment cannot be processed, you should contact your card issuer to try to resolve the problem or use an alternative payment method to continue with your order.
In paying or attempting to pay for Goods, you agree that you have not engaged in any fraudulent conduct or contravened any Law.
We offer the following delivery options for our customers.

For partners deliveries not made via Arte et Marte Puzzles, please refer to our Third Party Sellers for individual options available.
Dispatch times may vary according to availability. Any representations made regarding delivery times are estimates only and are subject to delays resulting from postal delays or force majeure for which we are not responsible.
Your order may be fulfilled from multiple locations at different times depending on stock availability. You won’t be charged any more for delivery in this instance.
A signature on delivery may be required. If you refuse to sign the delivery document, this will be taken as refusal to accept delivery.
If no-one is at the delivery address or there is limited access to the delivery address, and a signature is not required for the delivery, the Delivery Agent will leave a collection card with instructions on where to collect the goods.
For big or bulky deliveries, your order will be referred to a delivery service provider who will contact you directly to arrange delivery and request any specific relevant access details such as stairs, parking restrictions. You or a person over the age of 18 must be available to accept delivery at the nominated delivery address on the date agreed between you and the Delivery Agent. If nobody is available at the address on that date additional delivery fees may apply for redelivery
Changes and Cancellations
Unless provided for under these Terms or as otherwise agreed, no cancellations or changes to orders will be accepted, and the goods will be delivered to the Delivery Address in your order. You should carefully check that your order is accurate before you submit it. You will, however, be able to return goods under the Returns Policy.
As a consumer, you are entitled to certain guarantees in respect of goods and services purchased from us. These guarantees are called Consumer Guarantees. The Australian Consumer Law, however does recognise that the relevant time period may vary by product (or service) depending on the nature of the goods (or service), the price paid and any representations made about the goods (or service).
Where you believe an item is faulty or defective, it may be necessary for us to send your goods to the manufacturer or their service agent for it to be assessed within a reasonable period of time. If the goods or service has a major failure, you may reject the good or service and seek a refund, exchange or repair or you may keep the item and seek compensation for any drop in value. If the failure is minor, we will repair the item (or, at our discretion, we may replace the item or refund you) within a reasonable time.
Where an item is damaged through misuse, neglect or abnormal use, we will not provide a refund, exchange or repair.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Where an item is purchased with a gift or bonus offer, the gift or bonus must also be returned (unless otherwise stated). If you are unable to return the gift or bonus or it is not in a saleable condition, the value of any available refund will be reduced by the value of the gift or bonus (in full or in part)
In the instance of bundle offers, all items within the bundle must also be returned or the value of the unreturned items will be deducted from any available refund.
Where a bonus Gift Card is issued at the time of purchase, the bonus Gift Card must also be returned with the merchandise to qualify for a full exchange or refund. Where the bonus Gift Card has been fully or partially redeemed, the amount redeemed will be deducted from any available refund.
Refunds for all purchases will be given using your original payment method (online purchases will automatically be refunded to the account used to pay). If points are used, they will reapplied to your account. If a gift card is used a replacement card or an existing card will be credited.
Refunds will be processed within a reasonable time of agreeing to do so.
If the original payment was made:
a) on a credit card, refunds will be processed on the same card as the original payment was made.
b) by a combination of gift cards and credit card then:
- refunds will be processed on the same card as the original payment was made first.
- return card for remaining amount will be emailed to the email address entered at the time you placed your order.
Our Gift Cards (Gift Cards) entitle the holder to goods/services equal to the value stated on the gift card or remaining after partial redemption.
Gift cards may not be exchanged (wholly or partly) for cash.
The value shown on a gift card includes GST.
Gift cards are partially redeemable and any unused balance will remain on the gift card and cannot be redeemed for cash.
If the holder’s order exceeds the amount of the gift card, the holder will be required to pay for the difference in price between the value of the gift card and the order value.
All gift cards sold expire 3 years from their purchase date
Should we suspect any fraud relating to a gift card, we may refuse to redeem the gift card until we are satisfied that no fraud has occurred.
Gift cards are not redeemable for other gift cards.
The credit of a gift card does not accrue interest nor can it be redeemed or refunded for cash at any time.
Promo Codes, Coupons or Reward Points
Promo codes are available onsite or through marketing partners. Only one voucher or promo code can be used per order. We may email coupons and promo codes to you or to your selected recipient.
It is your responsibility to ensure that the code is valid, and that you enter the code at the time of placing an order. The code cannot be applied after you have submitted your order. Separate terms may apply to the use of the code. The code may be specific to only certain orders or goods on the site.
Any code is non-transferable, cannot be posted on a forum or website and may not be used with other offers.
We accept no liability for errors in the email address provided to us. You are responsible for the use and safety of your offers – you should treat them like cash.
We assume no liability for the loss, theft or illegibility of promo codes and coupons used without permission, if your email is hacked or subject to unauthorised used.
We monitor the issuance and redemption of vouchers or codes. In the event of fraud, misuse, an attempt at deception (including self-referral) or in the event of the suspicion of other illegal activities in connection with the issuance or redemption of our offers, we may close or block access to your account and/or require a different means of payment.
Conditions for the redemption of coupons/promo codes include:
Coupon/promo codes are valid only for the specified period stated on them and can only be redeemed in accordance with any special terms stated on them – such as a minimum spend requirements, validity periods and brand, product or sale exclusions.
Only one coupon/promo code can be used per order, and some may only be used once per code. Coupons/promo codes cannot be used in addition to another offers.
Certain products may be excluded from the offer, and unless specifically stated are not applicable to shipping costs.
Coupons/promo codes cannot be redeemed for cash or to buy gift cards. If you place an order for a product less than the value of offer, no refund or residual credit will be returned to you. If the credit of an offer is insufficient for the order you wish to make, you may make up the difference through payment by other means (but not by using another voucher or attempting to rely on any other offer).
We will apply coupons/promo codes on a pro-rata basis to eligible items to determine the final price you pay for those items. Where you return an item purchased with a coupon/promo codes, we will only refund the final price you paid for that item.
We actively monitor misuse of coupons/promo codes and reserve the right to deactivate vouchers/promo codes or block any person that is not using a voucher in accordance with its Terms.
All references to times in promotions are based on the local time in Sydney, Australia unless stated otherwise.
The following definitions apply to these Terms.
Delivery Address means the address to which the goods are to be delivered, as stated on your order.
Delivery Agent means a third party delivery or shipping company engaged by us to deliver goods.
Delivery Fee means the applicable fee for the delivery of your order.
Gift Card means a preloaded Gift Card through which you or a recipient may make non-cash payments for orders.
Goods means the items offered for sale on the site.
GST has the meaning given in A New Tax System (Goods and Services Tax) Act 1999 (Cth).
Law means any written rule or collection of rules, including, but not limited to any statute, regulation, order or rule, any government ordinance or by-law, any governmental agency’s rule, regulation or determination, and any form of custom or policy recognised and enforced by judicial decision.
My Account means your online account through which you can facilitate your order, your points and coupons etc.
Order means a request by you to purchase goods from us or a Third Party Seller under these Terms.
Personal Information has the meaning given in the Privacy Act 1988 (Cth).
Price means the purchase price of each item as specified on the site.
Returns Policy means the conditions around our returns process
Third Party Seller Order means a request by you to purchase goods from a Third Party Seller under these Terms.
